TERMS AND CONDITIONS OF USE

Continuing to browse this Website constitutes full acceptance of the following Terms and Conditions of Use (TCU). The version currently online is the only enforceable one until it is replaced by a new version.

1. Access to the Website

Access to the FIncTek UE Website is reserved for adults residing in mainland France, in an overseas department or region (DROM), in another Member State of the European Union (EU) or of the European Economic Area (EEA), or in any other country accepted by FIncTek UE. FIncTek UE reserves the right to request proof of the User’s age or geographical location when browsing the Website, in order to access all or part of the Website and/or the Application Portal.

2. Website Content

All elements reproduced or used on the Website (including but not limited to trademarks, photographs, texts, comments, illustrations, still or animated images, video sequences, sounds, as well as all software applications) which are or could be used for the operation of the Website are protected under applicable intellectual property laws.
These elements belong to FIncTek UE or its partners. Any use of these elements—whether reproduction, representation, use, or adaptation, in any form whatsoever, in whole or in part, including software applications—is prohibited without the prior written consent of FIncTek UE. Any unauthorized use may result in legal action. Failure by FIncTek UE to take action immediately does not constitute a waiver of rights.

3. Website Management and Access Interruptions

To ensure proper operation of the Website, FIncTek UE may at any time:

  • suspend, interrupt, or limit access to the Website, or restrict access to certain categories of Users;
  • delete any information that may disrupt Website functionality or violate the TCU/TCS or national or international laws;
  • suspend the Website temporarily in order to carry out necessary updates.

4. Liability

FIncTek UE cannot be held liable in the event of technical problems preventing access to the Website or its functionalities.
The User is responsible for their own connection equipment and must take the necessary steps to protect it from Internet-based viruses.
FIncTek UE cannot be held liable for any legal proceedings brought against the User due to use of the Website that does not comply with these TCU.
FIncTek UE cannot be held liable for damages caused to the User, to third parties, or to their equipment due to the use of the Website by the User or said third parties. Consequently, the User waives any claims against FIncTek UE for such damages.
If FIncTek UE is involved in legal proceedings arising from non-compliant use of the Website under these TCU, it may claim compensation from the User for all damages, costs, penalties, and expenses resulting from such proceedings.

5. Hyperlinks

Creating hyperlinks to all or part of the Website is strictly prohibited without the prior written authorization of FIncTek UE. Authorization requests may be sent by email to: serviceclient.ue@finctek.com. FIncTek UE may refuse authorization without providing justification. If granted, authorization is temporary and may be withdrawn at any time. Upon request from FIncTek UE, any link must be removed.
FIncTek UE is not responsible for content accessible via links to other websites, as such content is beyond its control.

6. Collection of Personal Data

When browsing the Website, certain personal data may be collected, either to enable essential functionalities or for other purposes as described in the TCS.
The User’s personal data will not be used by FIncTek UE’s partners for direct marketing purposes.
The Website may automatically collect standard information through “cookies.” All indirectly collected information will only be used to monitor traffic volume, type, and configuration, to improve design and layout, for administrative and planning purposes, and more generally to enhance the Services offered by FIncTek UE.

7. Photographs and Service Representation

Photographs accompanying descriptions of Services are not contractual and do not engage the liability of FIncTek UE.

8. Language, Applicable Law, and Jurisdiction

These TCU are governed by French law. Any translation into a language other than French is provided for information purposes only, and the French version shall prevail in the event of dispute.
Unless otherwise required by law, any dispute relating to these TCU shall be submitted to the ordinary courts under the jurisdiction of the Paris Court of Appeal.
Pursuant to Article R. 631-3 of the French Consumer Code, a Customer qualifying as a Consumer may also choose to bring proceedings before:

  • any territorially competent court under the French Code of Civil Procedure; or
  • the court of their place of residence at the time of entering into the TCS or at the time of the damaging event.
    This jurisdiction clause is not enforceable against FIncTek UE in the event of a dispute involving a Consumer residing outside the European Union.
